Terms and Conditions

 These Terms & Conditions (“Terms”) govern all purchases made through hacklebackcaviar.com and any related ordering channels operated by Hackleback Caviar (“Hackleback Caviar,” “we,” “us,” or “our”). By placing an order, you agree to be bound by these Terms.

If you do not agree, please do not place an order.


1. Product Shipping Location

All orders are processed and shipped from Illinois, USA.

We currently ship to all 50 U.S. states.


2. Perishable Food — No Returns / All Sales Final

Because caviar is a highly perishable food product, we cannot accept returns for any reason once an order has shipped.

All sales are final.

This includes (but is not limited to):

  • change of mind
     
  • ordering by mistake
     
  • dissatisfaction with taste or preference
     
  • failure to refrigerate or store properly
     
  • delays caused by carrier once shipped
     
  • gift orders not accepted by recipient
     

Please review your order carefully before submitting.


3. Order Processing & Acceptance

Your order is considered an offer to purchase.
We reserve the right to:

  • accept or reject any order
     
  • limit quantities
     
  • cancel an order and issue a refund (for example, inventory mistakes, suspected fraud, or errors in pricing)
     

You will receive confirmation when your order is accepted and prepared for shipment.


4. Shipping, Delivery & Risk of Loss

Orders are packaged with appropriate cooling materials and shipped using reputable carriers.

Once an order is transferred to the carrier:

risk of loss and responsibility pass to the customer.

We are not responsible for:

  • incorrect or incomplete shipping addresses
     
  • missed delivery attempts
     
  • packages left outside
     
  • weather-related delays
     
  • carrier delays beyond our control
     

Please track your shipment and ensure someone is available to receive and promptly refrigerate the product.


5. Product Quality & Storage

Caviar must be refrigerated immediately upon arrival.

Quality can be impacted if:

  • the package sits unattended
     
  • refrigeration is delayed
     
  • the lid is opened and exposed to air
     
  • the product is mishandled
     

We are not responsible for spoilage resulting from improper handling after delivery.

If there is a clear product defect upon arrival, contact us within 24 hours with photos and your order number, and we will review the situation at our discretion.


6. Pricing & Availability

Prices and availability may change at any time without notice.

If a pricing or listing error occurs, we may cancel or adjust the order and notify you.


7. Allergies & Consumer Responsibility

Customers are responsible for reviewing product descriptions and ingredients before purchase.

Fish roe may not be suitable for individuals with seafood allergies or dietary restrictions. Please consult your physician if unsure.


8. No Resale Without Permission

Products purchased from Hackleback Caviar are intended for personal use only, unless you have written authorization from us to resell.


9. Disclaimer of Warranties

To the fullest extent permitted by law, the products and services are provided:

“AS IS” and without warranties of any kind, express or implied.

We disclaim any implied warranties of:

  • merchantability
     
  • fitness for a particular purpose
     
  • non-infringement
     

10. Limitation of Liability

To the maximum extent permitted by law:

Hackleback Caviar and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of our products.

Our total liability, if any, will not exceed the amount paid for the product involved.


11. Indemnification

You agree to indemnify and hold Hackleback Caviar harmless from any claims, losses, or damages arising out of:

  • your misuse of the product
     
  • your violation of these Terms
     
  • your failure to follow storage and handling instructions
     

12. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in state or federal courts located in Illinois.

We may update these Terms from time to time. Updated versions will be posted on this page and apply to future purchases.
